Legal Affairs

The Legal Affairs Diplomatic Disputes and Treaties Service is the bureau of the Ministry of Foreign Affairs and International Cooperation responsible for looking after the interests of the country in the field of international law.

Among its various responsibilities, the Service provides advice to Administration offices on technical and operational aspects regarding international treaties and holds their archive, works with Government Officers to uphold the rights of the country before the main international courts and provides advice on international, internal and comparative law to the various offices of the Administration and, through them, to the diplomatic and consular network.

In detail, the Service deals with the following matters:

International treaties and disputes

Legal assistance with negotiating, signing and ratifying international treaties to which Italy is a Party; keeping the archive of treaties and storing the originals; supporting the Legislative Office of the Ministry of Foreign Affairs; assisting with the drafting of internal legislation transposing international treaties and conventions signed by Italy; working with Government Officers during the various stages of international procedures.

Multilateral International Bodies

Attending multilateral technical and legal meetings in the main international organisations including the UN, EU and Council of Europe.

International courts

Supporting Italian Government Officer in upholding the rights and interests of the country before international Courts and Tribunals, particularly the Court of Justice of the European Union in Luxembourg, the European Court of Human Rights in Strasbourg and all the international judicial or arbitration bodies in which Italy is required to intervene (including ICSID, International Criminal Court, International Tribunal for the Law of the Sea).

Internal courts

Preparation and coordination of the Aministration's defence in respect of actions taken by external individuals and organisations, as well as legal actions taken by the Administration against them - excluding disputes involving staff of the Ministry of Foreign Affairs - through the State Attorney's office. Assistance with managing disputes abroad involving the interests of the Administration, including those relating to the Administration's immovable property.

 Legal advice

Provision of legal advice on legal issues submitted by the various offices of the Administration and, through them, diplomatic and consular offices; assistance with preparing tender documents and contractual instruments. Advice on public international, comparative and private international law.
