Court of Justice of the European Union
The Legal Affairs Service provides support to the Agent of the Italian Government at the Court of Justice of the European Union (CJEU), acting as Registrar of the Italian State for all procedural acts notified by the CJEU and the General Court in Luxembourg.
Pursuant to Law 234 of 2012 (‘General provisions on Italy’s participation in the creation and implementation of European Union legislation and policies’), regular interministerial coordination is also promoted and managed, jointly with the Department for European Policies of the Presidency of the Council of Ministers and with the State Legal Service, for the definition of the Italian position in cases before the Court of Justice and the General Court of the European Union, for the purposes of the best defence of the State in legal proceedings.
International Courts
The Legal Affairs Service, in cooperation with the diplomatic and consular network, monitors jurisdictional activity and regulatory and organisational developments relating to the main international and supranational Courts and Tribunals (also including- besides the CJEU – the ICJ, ICC, CPA, Special Tribunal for Lebanon, Kosovo Specialist Chambers, and the International Residual Mechanism of International Criminal Tribunals).
These competences include the activity of providing legal opinions and legal assistance and advice, with specific reference to cases directly involving Italy and – in some specific cases – Italian citizens and foreign States.
International Arbitrations
The Service for Legal Affairs, Diplomatic Disputes and International Treaties collaborates with the State Legal Service, and with the relevant technical Administrations, in protecting Italy before the main international courts and arbitration tribunals (particularly in investment matters), providing support and advice in managing relations and initiating arbitration procedures, as well as in promoting interpretations and regulatory changes aimed at adapting the European and international regulatory framework to Italy’s interests.
