European Medicines Agency (EMA)

The Minister of Foreign Affairs and International Cooperation, Enzo Moavero Milanesi, confirms that the Government, through the State Legal Advisory Service, has lodged an appeal with the European Court of Justice against EU Regulation 2018/1718 that establishes the new headquarters of the European Medicines Agency (EMA) in the city of Amsterdam.

The impugnment of the EU Regulation is the logical consequence of the appeal lodged last year by the Government – and still pending before the European Court of Justice – against the EU Council’s decision to assign the new EMA headquarters to Amsterdam after the EU Agency leaves London following the so-called Brexit.

The new appeal confirms Italy’s resolve to submit to a dutiful jurisdictional scrutiny the legitimacy of the procedures followed in deciding the new EMA headquarters, in the light of the fact that the candidacy of the city of Milan offered all the immediate guarantees necessary to assure the operating continuity of an EU Agency like EMA, which is key to safeguarding the health of the citizens of the European Union.
