Marines: High Court decision on jurisdiction postponed. Decision on transfer “to a place other than prison” expected within a week. Right to apply for freedom on bail

The Supreme Court in New Delhi has postponed until 26 July 2012 Italy’s appeal regarding the constitutional legitimacy of the arrest of the two Italian marines. Massimiliano Latorre and Salvatore Girone are accused of killing two Indian fishermen. The reason for the long adjournment is the summer break, from 14 May to 2 July, of India’s highest judicial body.


The High Court has also ordered the State of Kerala to take a decision, within a week, on transferring the two marines to “a place other than prison”. The Court’s order also specifies that the transfer of the two marines “does not limit their right to apply for freedom on bail”.
